If you purchased Credentials for the 2020 South by Southwest Conference & Festivals in Austin, Texas, you may be a Class Member.

A court authorized the notice. It is not a solicitation from a lawyer.

 

There are two classes in the proposed settlement:

(1) Deferral Class: All persons, wherever located, who purchased credential(s) for SXSW 2020 from SXSW pursuant to SXSW's Participant and Credentials Terms and Conditions and later accepted SXSW's offer to defer those credential(s) to a later year are members of the proposed Deferral Class; and

(2) Non-Deferral Class: All persons, wherever located, who purchased credential(s) for SXSW 2020 from SXSW pursuant to SXSW's Participant and Credentials Terms and Conditions but did not accept SXSW's deferral offer are members of the proposed Non-Deferral Class

 

YOUR LEGAL RIGHTS AND OPTIONS

Your legal rights are affected whether you act or don't act.

CLAIM FORM DEADLINE Claim forms must be submitted and received no later than December 20, 2021.
DEFERRAL CLASS PAYMENT DEADLINE SXSW will issue a payment of $30.00 to each member of the Deferral Class (defined above) within 60 days of the Effective Date.
DEFERRAL DEADLINE Members of the Deferral Class may change their currently selected deferral year to either 2022, 2023, or 2024, but must give notice of such change no later than January 15 of their currently selected deferral year. 
NON-DEFERRAL CLASS ELECTION DEADLINE Members of the Non-Deferral Class have until December 20, 2021 to notify SXSW whether they choose to remain in the Non-Deferral Class or join the Deferral Class by submitting a Claim Form.
NON-DEFERRAL CLASS PAYMENT DEADLINE SXSW will issue to members of the Non-Deferral Class (defined above) a refund of 40% of the total amount they paid to SXSW for Credential(s) within 60 days of the Effective Date.
EXCLUDE YOURSELF FROM THE SETTLEMENT BY SUBMITTING A WRITTEN REQUEST FOR EXCLUSION Remove yourself from the Class and get no payment. This is the only option that potentially allows you to ever be part of any other lawsuit against SXSW about the legal claims being resolved by this Settlement. Should you elect to exclude yourself from the Class, you should understand that SXSW will have the right to assert any and all defenses they may have to any claims that you may seek to assert, including, without limitation, the defense that any such claims are untimely under applicable statutes of limitations and statutes of repose. Exclusions must be in writing and postmarked on or before December 20, 2021.
OBJECT TO THE SETTLEMENT BY SUBMITTING A WRITTEN OBJECTION Write to the Court about why you do not like the Settlement, the Plan for Benefit Distribution (defined below), and/or the request for attorneys’ fees and expenses.  You will still be a Member of the Class. Objections must be in writing and postmarked on or before December 20, 2021.
GO TO THE HEARING ON FEBRUARY 18, 2022, AND FILE A NOTICE OF INTENTION TO APPEAR Ask to speak in Court about the fairness of the Settlement.  Requests to speak must be in writing and postmarked on or before December 20, 2021.  If you submit a written objection, you may (but you do not have to) attend the hearing.
DO NOTHING You will be a Member of the Class, which means that you give up your right to ever be part of any other lawsuit against SXSW about the legal claims being resolved by this Settlement and you will be bound by any judgments or orders entered by the Court in the Litigation.
